Extremely rare legal publication, not in STCV, signed by J. vander Beke, concerning Nieuwenbos Abbey's right of tithes on the "Clarapolder" (1614) and "Isabelle Polders". Includes 2 maps presumably made by Jan Bale, Ghent sworn land surveyor for St. Pieters around 1650. While Van Baele used previous maps by Lieven van Thuynen (Rijksarchief te Gent - VZ1 - 24) for mapping the polders, many maps made by his hand, dated mid 17th c., belong to the Ghent State Archives. One in particular, the "Figurative kaert van den St-Clara, Laurina, St-Barbelen [...]" made by J. Bale in 1652 (Rijksarchief te Gent - VZ1 - 703) and coming from the St. Peter's Abbey archives is relevant, as it was used in the lawsuit between the prelate of St Peter's Abbey and the parish priest of Boekhoute, Arnold Borquelmans, on the one hand, and the abbess of the Nieuwenbos Abbey on the other. Same goes for our "Applicat" that includes: 1. "Caerte van Nieuwenbossche", showing the Clarapolder, de Laurijnepolder, de Sint-Jorispolder, de Christoffelpolder, de Hellepolder, de Fossierpolder, de Salvatorspolder, de Cappellepolder, de Rooden Polder, de St. Janspolder, de St. Pieterspolder, de Philippinepolder; and the now-disappeared "Kercke van Piet" which plays a crucial role in the lawsuit. - 2. "Caerte van Ste Pieters", showing the same polders, as well as the Sint-Barbarapolder, Sint-Annapolder, Coekuutspolder, St-Nicasiuspolder, Abbekenspolder. Both maps are rare and probably the only copies known.
After the whole area was flooded in 1621 and 1622, the right of tithes became important again as permission was granted to re-dike the region after the Peace of Munster (1648). Another element contributing to the discussion is the fact that A. Borquelmans was appointed acting pastor in 1648. The verdict, at the end, dates from 5 April 1653.
